New Delhi: The Supreme Court has ruled that the order issued by the Government of Tamil Nadu giving 10 percent reservation in police jobs to the heirs of the Tamil Nadu Police will go ahead, and has ordered to cancel the order issued by the Madurai Branch of the High Court in this regard.
In order to encourage the morale, loyalty and honesty of the policemen working in the Tamil Nadu Police Department, former Chief Minister Jayalalithaa ordered to give 10 percent reservation in police jobs to the successors of the policemen. Based on that, an ordinance was issued in 2001.
In this case, the son of a retired police officer filed a case in the Madurai branch of the High Court seeking employment on the basis of this 10 percent reservation. The single judge heard the case and dismissed the case.
A two-judge bench of the High Court hearing an appeal filed against it said that the opportunity to enter public employment should be given equally to all citizens. Also, in 2018, they canceled the decree saying that the 10 percent reservation was illegal.
More than 100 people appealed to the Supreme Court against this order. As this case has been pending for a long time, it came up for hearing yesterday in a session consisting of Justices SK Kaul, Abhay S. Oha and PV Nagaratna.
At that time, senior lawyer Sanjay Hegde and lawyer Joseph Aristotle appeared on behalf of the Tamil Nadu government and said, “The order issued by giving 10 percent reservation in employment to the successors of policemen working in the Tamil Nadu police department is not illegal in any way. This placement will boost motivation and morale among the guards and their families. “The families of the policemen have suffered because the Madurai branch of the High Court has canceled this reservation without proper scrutiny,” they argued.
Following this, the judges said, “The decree issued by giving 10 percent reservation in the vacant posts in the police department will go to the heirs of the policemen working in the Tamil Nadu Police Department. Based on that, not only those who are currently pursuing the case, but all those who are qualified can be given jobs following due reservation.
The order issued by the Madurai Branch of the High Court in this regard is quashed. “Furthermore, there is no restriction on applying in the Tamil Nadu Police to the eligible persons who have lost their opportunity due to the order of the Madurai branch of the High Court, and based on this order, there is no restriction on the relaxation of the age limit.”
