A Colorado welding company, identified as JMF Enterprises, wanted to pay a subcontractor $23,500 dollars in coinswhich caused a conflict in which a judge had to intervene.
The case was reported by CBS News, after JMF Enterprises showed up with a truck full of coins to pay services to Fired Up Fabrication for work on an apartment building.
The reasons are not known, but who was going to receive payment in coins was dissatisfiedso the intervention of a judge was resorted to, who considered that JMF acted “maliciously and in bad faith.”
Larimer County Judge Joseph Findley said the incident was intended “thwart and undermine” to the recipient by making the payment “cumbersome and expensive”.
Given the facts, JMF and its owner, John Frank, were ordered to pay the subcontractor in a conventional manner, through a check or money order.
As if that were not enough, JMF was also ordered pay Fired Up Fabrication’s attorneys’ feesfor the time they dedicated to the case.
What is known is that JMF hired Fired Up Fabrication to work on an apartment building. Once the work was completed, the subcontractor filed a civil lawsuit, arguing that JMF did not pay him in full for the work.
The two companies resorted to mediation to resolve the dispute in July and it was agreed that JMF was required to pay Fired Up Fabrication $23,500.although it was not specified how the payment should be made.
In August, JMF made good the payment by giving Fired Up Fabrication’s legal representative a huge box full of coins. twenty-five, dimes, nickels and centswhich weighed more than 6,500 pounds or 3 tons.
Fired Up Fabrication Attorney Danielle Beem He rejected the delivery and described the action as “petty” and a “waste of time.”.
JMF tried to get the court to force her to accept the mountain of coins, but The judge agreed with the legal representative of Fired Up Fabrication.
