New Delhi. The Supreme Court has expressed displeasure over the bulldozer action. The court gave strict comments on this matter while giving instructions to all the states on this matter. The court said that the house cannot be demolished just because there is an accused, no one can be held guilty without a trial.
The administration cannot become a judge on this matter (bulldozer action). If the house is demolished illegally then compensation should be given. The Supreme Court said that officers taking illegal action should be punished. Hearing cannot be conducted without hearing anyone’s side. The court further said that the information about the notice should be given to the District Officer (DM).
The Supreme Court said that the order should also be sent to the Chief Secretaries of all the states. An opportunity should be given to remove illegal construction. Information should be given in the notice as to how the house is illegal. Notice should be given as per the rules of the local municipal corporation. At the same time, no action should be taken within 15 days of giving the notice. While reading the decision, the court said, “The names of the officers present in the bulldozer action should be recorded. At the same time, videography of illegal construction should also be done.”
The Supreme Court said that if there is only one accused in a case then why should the entire family be punished by demolishing the house. The entire family cannot have their house taken away. While delivering the verdict, the court said that the DM of every district will appoint a nodal officer for the demolition of any structure in his jurisdiction. While reading the verdict, the court also said that the court will keep an eye on the bulldozer action taking place in the country.
