San Francisco. Apple will stop selling its Watch Series 9 and Ultra 2 smartwatches in the US this week due to a patent dispute.
According to a report by 9 to 5 Mac, both the recently launched Apple Watches will not be available for purchase online from December 21.
Inventory will not be available at retail stores after December 24th.
The move follows the recent ruling by the International Trade Commission (ITC), which is part of a long-running patent dispute between Apple and medical technology company Masimo over the watch’s blood oxygen sensor (SpO2 sensor) technology.
The company said that they have to already comply with the ITC import ban following the patent dispute.
The ITC announced its decision in October, upholding the judge’s ruling from January.
The ITC ban will only affect sales of the Series 9 and Ultra 2 within the US, the watches will still be available for sale overseas.
Masimo is known for its pulse oximeter.
The company filed two separate cases claiming Apple infringed their pulse oximetry technology.
In a statement, an Apple spokesperson said it strongly disagrees with this order and is pursuing a number of legal and technical options to ensure that the Apple Watch remains available to customers.”
The ITC import ban decision is currently undergoing a review period, and President Joe Biden will have the opportunity to veto the ban.
“If the order is upheld, Apple will continue to take all measures to return Apple Watch Series 9 and Apple Watch Ultra 2 to customers in the United States as quickly as possible,” an Apple spokesperson said.
Apple is also working on software changes to how the Watch measures and reports oxygen saturation.
