LucknowThe Supreme Court has given a big decision regarding the madrassas of UP. The Supreme Court on Tuesday rejected the decision of the Allahabad High Court and granted constitutional recognition to madrassas. The High Court had declared the UP government’s law on Madrasas (Madrasa Act) made in 2004 as unconstitutional.
The bench of Supreme Court Chief Justice DY Chandrachud, Justice JB Pardiwala and Justice Manoj Mishra has given this decision. The Supreme Court had reserved its decision on eight petitions including the main petition of Anjum Qadri on October 22. On March 22 this year, the High Court had termed the ‘Uttar Pradesh Madrasa Education Board Act-2004’ as violating the principles of secularism and declared it ‘unconstitutional’.
The High Court had directed the UP government to include the students studying in different madrassas of the state in the formal education system. On April 5, the Supreme Court had given relief to about 17 lakh Madrasa students by imposing an interim stay on the High Court’s order to repeal the ‘Uttar Pradesh Madrasa Education Board Act-2004’.
Let us tell you that about 25 thousand madrassas are running in Uttar Pradesh. Of these, about 16,500 madrassas have taken recognition from the State Madrassa Education Council. Of these, 560 madrassas receive government grants. At the same time, about 8500 madrassas are unrecognized.
