New Delhi: It has directed Maharashtra Speaker Rahul Narvekar to fix a deadline for taking a decision on the disqualification of Chief Minister Eknath Shinde and other Shiv Sena MLAs.
The Supreme Court also asked to respect the Supreme Court’s order of May 11 and insisted on a decision on the disqualification of Shiv Sena MLAs within a reasonable time.
Shiv Sena party split into 2 in Maharashtra last year 2022. More than 40 MLAs supported the BJP led by Eknath Shinde. The coalition government was subsequently overthrown. Uddhav Thackeray resigned as Chief Minister.
After that a BJP-Shiv Sena (Eknath Shinde wing) coalition government was formed in Maharashtra. Eknath Shinde is acting as Chief Minister and BJP’s Devendra Fadnavis as Deputy Chief Minister.
In this case, MLA Sunil Prabhu, who was the whip of the combined Shiv Sena, had given a letter to Speaker Rahul Norvekar to disqualify 16 people including Eknath Shinde. Similarly, Shinde’s side issued a letter to disqualify the MLAs of Uddhav Thackeray’s team. But the Speaker did not take any action.
Subsequently, Uddhav Thackeray’s side filed a case in the Supreme Court. The petition said that the Speaker should be ordered to take immediate disqualification action against Shinde and others. Following this, the court, which conducted an inquiry, ordered that action should be taken as soon as possible.
In this situation, the petition filed by Shiv Sena (Uddhav Thackeray’s team) MLA Sinil Prabhu seeking an order to speed up the Speaker’s decision on the two-party disqualification issue was dismissed by Supreme Court Chief Justice T.Y. A bench comprising Justices Chandra Chute, JP Pardiwala and Manoj Misra came up for hearing on Monday. The court said that the judges then asked Sabanayar to decide on the disqualification case within a reasonable time on May 11 and after that no action was taken except to send notices to the MLAs in July.
Meanwhile Shiv Sena (Uddhav team) MP. Sanjay Raut said, “Despite the clear order of the Supreme Court, the Speaker is wasting his time without taking action on the disqualification petitions. It is noteworthy that he is supporting the anti-constitutional government in the state.
