Elizabeth Webster and Alexander Burckle, a couple from California, filed a lawsuit against the Sail Maui company, since it allegedly abandoned them in the middle of the ocean when they went on an excursion diving during their honeymoon in September 2021.
Webster and Burckle are seeking $5 million in damages and emotional distress, alleging that Sail Maui was negligent and failed in its duty to care for its customers.
The dive company took them on an excursion to the Lanai Coast, off the island of Maui, in Hawaii. When Elizabeth and Alexander were at the bottom of the sea, the ship simply departed, leaving them stranded.
“They spent a lot of time in the water, and if they weren’t young, healthy, athletic people, they probably would have drowned,” the couple’s attorney, Jared Washkowitz, told Insider.
It turned out that the couple had experience diving, which helped them survive.. Before entering the water, they had been told that they had an hour to dive before moving on to the next point of the tour.
Despite these directions, the couple say it was not clear where they should meet to get on the boat, nor were they given an exact time to meet, nor were they told if there was a certain area in the water where they needed to stay.
The couple had been diving for about an hour in the water when they decided to get out as the water became rougher.. The couple began to swim towards the boat, but it was impossible to reach it due to the strong waves.
Elizabeth and Alexander kept swimming, but they noticed that the boat was getting further away.
Meanwhile, on the boat, the workers helped the hikers on board and made three counts, two of which went wrong, and only the third came out correct.
The ship’s crew decided to leave, this despite the fact that several people alerted that the newlyweds were missing.
The couple managed to reach a nearby beach after swimming for two hours. There, a couple of residents found them and helped them.
