Complaints of Moroccan citizens continue about the delay of territorial communities in responding to requests related to reconstruction issues such as construction, repair, demolition, etc., until some entered into administrative disputes with some officials over this delay.
Because of this, Akhannouch’s government was forced to issue a decision obligating the territorial communities and the competent authorities to issue decisions regarding reconstruction within a reasonable time, to protect the interests of citizens and narrow the margin of manipulation by some elected officials in this file.
The Minister of the Interior, Abdel Wafi Laftit, and the Minister of National Land Development, Fatima Zahraa Al-Mansouri, issued a joint decision obligating the groups to issue their administrative decisions related to reconstruction within deadlines ranging from 15 to 30 days.
The matter is related to determining the deadlines for each participant in terms of processing and handing over the application file for obtaining some construction permits, especially the permission to create real estate fragmentation, the permission to create a residential group, the permission to divide real estate, and building permits.
The joint decision specified for licenses and permits related to real estate divisions, residential groups and real estate divisions, as well as building permits related to major projects, a maximum deadline of 30 days in order to process application files and hand over related licenses.
With regard to the delivery of the receipt for depositing the license application file, the government decision set a deadline of one day only, and 3 days for referring the license application file to the study committee, 15 days for studying the license application file by members of the study committee, 3 days for directing the minutes of the study committee’s work to the president of the congregation to take a decision on it, and 3 days to inform the president of the congregation council to the person concerned about the results of the study committee’s work, and in the event of approval, 5 days to issue and hand over the license by the president of the congregation to the person concerned.
As for building permits related to small projects, the decision set a maximum period of 15 days for processing application files and handing over the related permits. As this period was divided into one day with regard to handing over the receipt of depositing the permit application file and referring the file of the building permit application to the study committee, and 7 days to study the permit application file by members of the study committee and two days to direct the report of the study committee’s works to the head of the group or district to take a decision on it, and two days to inform the head of the group or district council to the person concerned about the results of the study committee’s work, and finally, and in the event of approval, 3 days, to issue and hand over the license by the head of the group or district to the person concerned.
