Jammu and Kashmir.Amidst speculations of holding assembly elections, the central government has made a major change in the law in Jammu and Kashmir. The central government has amended the Jammu and Kashmir Reorganization Act, 2019. Now the Lieutenant Governor of Jammu and Kashmir has been given the same powers as the LG of Delhi.
Now after this, the Lieutenant Governor has got more powers in the cases of appointment of All India Service officers, police transfer and posting as well as judicial officers. In fact, the Central Government has issued a notification on Friday amending the ‘rules’ under the Act. This notification states that the President has made new rules to further amend the Jammu and Kashmir Union Territory Government Rules, 2019.

These rules may be called Jammu and Kashmir Union Territory Government (Second Amendment) Rules, 2024. They will come into force from the date of publication in the official gazette. This amendment will give more power to the Lieutenant Governor of Jammu and Kashmir in matters of transfer and appointment of All India Service officers like IAS and IPS, police, law and order as well as judicial officers. Sub-rule 2A has been added after sub-rule (2) in Rule 5 in the ‘Conduct of Business Rules’.
The new rule (2A) states that no proposal which requires the previous consent of the Finance Department for the exercise of the discretion of the Lieutenant Governor under the Act in respect of ‘Police’, ‘Public Order’, ‘All India Services’ and ‘Prevention of Corruption Bureau’ shall be accepted or rejected unless it is placed before the Lieutenant Governor through the Chief Secretary.
