Reminding the judicial year that was opened today, Minister Tunç stated that important messages were given at the ceremony and wished the new judicial year to be beneficial.
Stating that important legislative arrangements have been implemented in the field of judiciary, Tunç said, “When we compare what our judicial system was 21 years ago to where we are today, we see that there has been a great progress.” said.
On the question about the new constitution, Tunç reminded that reconciliation commissions regarding the new constitution had been established before and no results were reached. Tunç said, “We want to provide our nation with a new, civilian constitution that we can call a social contract, which is democratic, civil, fully reveals the rights of citizens and the duties of the state.” he said.
Stating that all parties with or without groups in the parliament agreed on a new constitution, Tunç said, “The important thing here is to achieve a compromise. We have to achieve this compromise. This is the debt of all political parties to this nation. We want to lead here.” used his statements.
Stating that the constitution has made arrangements that can be considered as reforms in terms of both the judiciary, the Presidential Government System and fundamental rights, Tunç said, “These changes were not enough to remove the total tutelage spirit of the constitution. Noting that the parliament will start the new legislative year on October 1, Tunç said, “As our group and the People’s Alliance, we will bring these two amendments to the agenda of the parliament, and hopefully we will implement the constitutional guarantee for the headscarf and the 41st article on the protection of the family.” said.

Reminding that the compulsory mediation practice in rent, condominium, dissolution of partnership and neighborhood disputes started today, and giving information about the applications made on the first day, Tunç said, “As of today, 494 applications have been received. 438 applications arising from tenancy disputes have gone to mediation. There have been 19 applications arising from the dissolution of the partnership and the disputes. There were 32 applications due to condominium disputes. There were 4 applications for disputes arising from neighborhood law. There were 1 applications due to agricultural production disputes.” said.
Stating that the mediators will quickly invite the parties to a meeting and try to reconcile them after the applications, Tunç said, “The mediator will prepare the ground, he will not offer them a solution. They will find their own solutions. They will tell each other what they want and they will finish it in three weeks, one week additional time, 4 weeks.” per week.” he said. Tunç stated that if an agreement is not reached as a result of mediation negotiations, a lawsuit may be filed.
Stating that the mediation system reduces the workload of the judiciary and allows ongoing cases to be heard in a more qualified manner, Tunç said that the scope of alternative dispute resolution methods, which provide peaceful, friendly and rapid results with low costs, can be further expanded in the new period.
“We cannot accept that the divorce case will take 5-10 years”
Stating that long-lasting divorce cases victimize the parties, Tunç stated that these cases should be concluded in a short time.
Tunç said, “We cannot accept that a divorce case takes 5 or 10 years. Of course, this is not due to the inability of our judicial members to make a decision. When the separation of property between the parties, alimony and compensation problems are all handled in a single case, the divorce case is also delayed in this process.” he said.
Noting that they can evaluate the divorce and compensation issues separately, but this is not a definitive decision, Tunç said that they want to find solutions to these problems, with the opinions of lawyers, as a result of the symposium they will organize on family law.
Minister Tunç said that they will carry out a study in the coming days that will not victimize women regarding alimony and will resolve the complaints of the “other party”.
