Noemí Berenice Luna Ayala, PAN deputy, presented a reform initiative to the Federal Roads, Bridges and Motor Transportation Law, in order to establish that driving while intoxicated, under the influence of drugs or abuse of toxic substances, the driver’s license is canceled immediately.
The PAN deputy proposes to reform articles 36 and 70 of said law, in addition to suspending or
cancel licenses
for talking on a cell phone or any other electronic device,
unless it is done with hands-free technology.
“Also reading or sending text messages or exceeding the maximum speed limits established by the Secretariat.”
What do articles 36 and 70 of the Federal Roads, Bridges and Motor Transportation Law say?
Article 36. Drivers of federal motor transportation vehicles must obtain and, where appropriate, renew the federal license issued by the Secretariat, under the terms established by the respective regulations. Drivers of vehicles referred to in articles 40 and 44 are exempt from this provision.
Article 70.The Secretariat will be in charge of the inspection, verification and surveillance of roads and bridges, as well as federal motor transportation services, their auxiliary services and private transportation, in their technical and regulatory aspects, to guarantee compliance with this Law, its regulations. and the official Mexican standards issued in accordance with it. For this purpose, it may request at any time from the concessionaires and permit holders reports with the technical, administrative, financial and statistical data, which allow the Secretariat to know how to operate and exploit roads, bridges, federal motor transportation services and their auxiliary services.
Luna Ayala explains that in terms of federal public transportation, the vehicle fleet is increasing. From the year 2000 to 2020, the public transport fleet of cargo went from 388 thousand vehicles to more than one million 100 thousand units.
“Unfortunately, the road infrastructure does not advance at the same speed, which is why it is necessary to have stricter controls that adhere to the Official Mexican Standards that govern federal roads, in order to minimize accidents, but above all with the purpose of prevent loss of life.”

Among the consequences of vehicular accidents, he mentions: loss of life, injuries, psychological, property, material damage, to third parties and to road infrastructure, as well as economic and legal civil or criminal liability.
The legislator points out that incorporating into the law the possibility of authorizing third parties
The use and/or installation of new technologies to measure speed control, weight and dimensions, it is not intended to prohibit traffic, rather, It is about regulating and improving the coexistence and circulation of vehicles, seeking to safeguard the physical integrity of people and reduce material damage, as well as the conservation and protection of road infrastructure.
