The Supreme Court has today issued notices to former IAS GS Sandhu, retired RAS Nishkam Diwakar and Onkarmal Saini in the single lease case, about 10 years old, seeking answers. Earlier, the Supreme Court has also issued a notice to UDH minister Shanti Dhariwal in the same matter.
Today, the Supreme Court also gave instructions to tag both the SLPs related to this matter. The Supreme Court gave this direction while hearing the SLP of Ashok Pathak. The High Court’s order dated 17 January 2023 has been challenged in the SLP.
The High Court accepted the action of withdrawing the case as correct.
The Rajasthan High Court upheld the state government’s action to withdraw the case against Sandhu and other accused. At the same time, that order of the ACB court was also cancelled. In which the court rejected the state government’s application to withdraw the pending case against the three accused including Sandhu.
It has been said in the SLP that the FIR of the case registered against corruption cannot be quashed only on the basis of the consent of the complainant. This case is the case of the state government which is against corruption. In such a situation, withdrawal of the corruption case against the accused by the State Government is not in the public interest and it will send a wrong message to the society. The High Court has upheld the action of the state government in spite of serious allegations of corruption in the case, which is wrong. Therefore, the order of the High Court should be set aside.
Single lease was issued to Ganpati Construction
In this entire matter, JDA had issued a single lease in the name of Shailendra Garg, the proprietor of Ganpati Construction. Whose complaint was made by the complainant Ramsharan Singh in ACB in 2013. While probing the case, the ACB arrested the then ACS GS Sandhu, Deputy Secretary Nishkam Diwakar and Zone Deputy Commissioner Onkarmal Saini, Shailendra Garg and two other accused and presented a challan against them in the ACB court. On the other hand, the investigation was kept pending in the case against others. As the matter escalated, the department had canceled the single lease.
