The Central Government and Delhi LG came face to face in the Supreme Court regarding the appointment of Chief Secretary in Delhi. On this, CJI DY Chandrachud asked why LG VK Saxena and CM Arvind Kejriwal could not sit and discuss the names for this post.
The CJI said that why not the LG and the Central Government prepare a panel of names, and the Delhi Government finalizes the name of one of them.
The Delhi government has raised questions in the Supreme Court as to how the Center can go ahead with the appointment of the Chief Secretary without any consultation when the new law is under challenge.
Delhi government had filed a petition against the Center
The court’s decision came after the intervention of AAP, in which the Delhi government had moved the court to seek extension of tenure of current Chief Secretary Naresh Kumar or appoint a new officer.
This challenge was given to the controversial ordinance, which had given control over the posting of bureaucrats to the central government. The Delhi government had argued that such appointments could not be made without its consultation. Delhi Chief Secretary Naresh Kumar is retiring on November 30.

Senior advocate Abhishek Manu Singhvi appeared in the court on behalf of Delhi government. He said that the Chief Secretary of Delhi is always appointed by the Delhi Government. What I am objecting to is the unilateral decision of LG.
Solicitor General Tushar Mehta, appearing in the court on behalf of the Central Government, mentioned the Delhi Services Bill. He said that the Union Home Ministry had made these appointments even before the amendment. The court has fixed November 28 for the next hearing in the case.
