The Attorney General’s Office of Mexico City (FGJ CdMx) will look for one or a new owner, after the ratification of Ernestina Godoy Ramos was not approved in the capital’s Congress.
Now the deputies must proceed in accordance with the provisions of the articles 119 and 120 of its Organic Law for the appointment of the successor of Godoy Ramos, who terminated his position on January 9, 2024 amid criticism and recognition from public opinion.
Ernestina Godoy needed 44 votes in favor to continue leading the FGJ CdMx for four more years, but the strength of Morena and her allies only served to gather 41 votes—of which two came from the Institutional Revolutionary Party (PRI).
Given this, the Citizen Judicial Council must prepare a shortlist of candidates for ownership of the justice institution that will be sent and evaluated by the Head of Government. Martí Batres, so that the name of the candidate is sent to the capital’s Congress.
Meanwhile, the current outgoing Attorney General will render the latest progress and achievement reportyes of his administration at the head of the institution he presided for five years.
What is required to be a Prosecutor?
Article 119 of the Local Constitution breaks down five requirements to consider when applying for the new Attorney General of Justice; The first of which is having Mexican citizenship and 35 years old for the day of appointment.
The second condition requires applicants to have a professional degree in graduate or graduate in lawin addition to having a minimum work experience of five years.
“Enjoy a good reputation” is the third requirement, although the legislation does not provide further details, clarifications or specifications regarding what this point refers to. Meanwhile, the fourth section prohibits accepting anyone who has been convicted or sentenced for intentional crimes.
Finally, the fifth point establishes that anyone who in the three years prior to the beginning of the examination process has served in “a deputyship in Congress, a magistracy, the position of judge or being a member of the Judicial Council of the Judicial Branch or head of a Secretariat or equivalent.”
The handover process
The procedure to renew the ownership of the FGJ CdMx begins within the Citizen Judicial Councilin charge of formulating and proposing a shortlist of candidates to the Head of Government Martí Batres Guadarrama.
The president will choose and send the name of a single person to the Board of Directors of Congress so that it can be assigned to the Administration and Justice Procurement Commissionwhich will interview the selected person.
If the members of the commission approve the proposal, it will return to the Board of Directors to consider it on the agenda of the following plenary session for the purpose of debate and subsequent voting. The City will have one or a new attorney general, since two thirds of the present legislative endorse it for a period of four years.
In follow-up with the the Organic Law of the FGJ CdMx, The institution will be in charge of the General Coordinator of Territorial Research, Oliver Ariel Pilares Viloriain which the ownership is renewed.
